What documents are required to obtain a cadastral passport. Technical and cadastral passports: what are the differences and how to obtain

Each residential property must have two passports: technical and cadastral. Without them, it is impossible to make transactions for the alienation of property. They are issued by government authorities upon request. Consider the procedure for obtaining a passport for an apartment in each case.

Technical passport: procedure for obtaining

In fact, this is a plan that provides a detailed description of all the parameters of housing. It contains information about the material, and the finish, and the description of the balcony or loggia. You can also check out the inventory appraisal here.

Technical documentation is issued during the initial inventory. It is carried out when the apartment is registered with the BTI. All changes in housing, including redevelopment, refurbishment or reconstruction, can only be carried out with the consent of the BTI. Information about them is reflected in such a plan. For their introduction, secondary and subsequent inventories are carried out. The law establishes that scheduled inspections of the condition of the apartment must be carried out every five years. In practice, this requirement is not always met.

The expiration date of the technical plan is not limited. It is the basis for the issuance of cadastral documentation.

Most buyers of housing in new buildings are wondering how to get a technical passport for an apartment in BTI. Many mistakenly believe that the developer should deal with this procedure. In fact, the developer is obliged to obtain a technical plan for the entire building, and not for individual apartments in it. This document is the basis for the issuance of technical documentation for a particular housing.

Engaged in the preparation of BTI passports. All its services are paid and paid for by the owner.

To obtain a primary document, the apartment owner submits a package to the BTI authorities, which includes:

  • an application for an inventory;
  • title documents for housing;
  • receipt of payment for BTI services.

This list is not exhaustive. To draw up and issue a primary document, the BTI authorities inspect the property. You can get it in a few weeks. It is kept by the owner.

The technical plan for the apartment will require:

  • for registration of inheritance;
  • to recognize housing as emergency, since the plan indicates the percentage of wear and tear;
  • for obtaining a housing loan;
  • to calculate property taxes.

Cadastral passport: obtaining algorithm

As mentioned above, it is issued on the basis of a technical. In fact, it is an extract from the state register, which indicates the most significant information about housing: the area of \u200b\u200bthe premises, useful area, floor, the presence of a loggia and a balcony. This information is reflected in the text part of the document. The number deserves special attention. It is assigned to each property upon its registration. By cadastral number, you can track all transactions with the apartment.

The graphic part of the extract contains a sketch of housing indicating the footage before and after planning, if it took place.

The document must be obtained if:

  • it is planned to carry out transactions with property;
  • was produced;
  • it is planned to evict the tenant without his consent through the court.

To obtain a document, you must contact the Cadastral Chamber. More recently, such a service has been provided through the site. Previously, the passport was issued at the BTI.

It can be obtained by the landlord and his tenants. However, putting housing on the cadastral register or making changes to the extract is the exclusive prerogative of the owner.

To make changes, he must apply to the Cadastral Chamber with the following documents:

  • statement;
  • documents confirming the legality of redevelopment;
  • legal information.

Nothing more is required of him. Therefore, questions about how to get a cadastral passport for an apartment should not arise.

For obtaining a cadastral passport, you will have to pay a fee of 1200 rubles. You can receive the document after five working days. It is not limited in time. The law establishes a certain reservation: the period of discharge may be different depending on the locality. Somewhere the passport is valid for only one year, and somewhere for five whole years. However, if the apartment had a redevelopment, it is better to replace it. Banks also insist on receiving an updated statement.

What is the difference

It should be understood that this is a completely different information and reference documentation. The technical data sheet contains more information. It contains the material from which the floors are made, and the year of commissioning, and the inventory value of housing. It is he who is used to evaluate the apartment.

The cadastral extract is mainly used in conjunction with form 7, since it contains the missing information.

Such documentation may be required not only for transactions with real estate, but also. Most banks, to check the purity of the transaction, request both a plan and an extract at the same time.

BTI

You will need to contact the Bureau of Technical Inventory in the following cases:

  1. If you need to get a cadastral plan for a land plot.
  2. To carry out the registration procedure in the register of a new premises.
  3. To make changes to the registry after redevelopment.

Through the BTI you can get a boundary and technical plan in order to subsequently issue a cadastral passport for the land plot. To obtain information and measurements, it is necessary to call a technician who will carry out the inspection and survey procedure. In this case, fresh documents from the BTI are needed to avoid errors due to which a passport may be denied.

Sellers of real estate may need to obtain a new cadastral plan at the request of the seller. At the same time, it is often necessary to obtain a new technical passport from the BTI. The fact is that in the process of inspection and preparation for the transaction, inaccuracies in the size of the rooms or redevelopment that are not indicated in the documentation may be found.

When redevelopment, depending on whether it was legal or not, you will need to bring the following documents to the Cadastral Chamber:

  1. Technical passport obtained from the BTI.
  2. Court decision (if the redevelopment was originally unauthorized).
  3. Conclusions of specialists of the SES and the Ministry of Emergency Situations.

In specific cases, the package of documents that must be provided from the BTI may vary. You can get the most accurate information from a specialist of the Cadastral Chamber, who will accept documents from you. In any case, the minimum package described above is best to have with you when you first contact.

USRR

An extract from the USRR is often required to sell an apartment. It is a document in which the cadastral number of the property is indicated. Also, in some cases, it may be required to issue a cadastral passport. Most often, an extract from the USRR is required if, when requesting data, inaccuracies were found in the documents.

It is also necessary to provide this document in order to issue a cadastral passport for land.

Certificate of cadastral number of real estate received in the department of Rosreestr. Previously, it was also issued in the Cadastral Chamber, but since 2013 there has been a separation of powers between organizations and the BTI, the Cadastral Chamber and Rosreestr have divided responsibilities. You can order, as well as get an extract from the USRR, using the Internet portal of the State Services and the official website of this department.

Copy of the passport

Documents on registration in the Cadastral Chamber can be obtained by any person by applying with a passport to the appropriate authority. At the same time, it is possible to obtain them on any apartment or other object whether or not he owns it. But only if this property was previously registered earlier.

In some situations, in order to make changes to the register or to register a new object, it is necessary for the owners to collect additional documents in order to obtain a cadastral passport with accurate, updated data. Only owners can get a new passport.

The package of documents for issuing a new cadastral passport usually includes a technical passport for housing, documents on ownership (if the apartment is not privatized, then you must provide a social tenancy agreement or an order).

For an apartment in a newly commissioned new building, it is necessary to submit to the Cadastral Chamber an act of transfer of real estate from the developer and an agreement with him.

If the matter of obtaining a cadastral passport for real estate is not handled by the owner himself, but by a trustee. Then it is necessary to confirm his authority with special documents certified by a notary.

Sample Documents

For those who are faced with the execution of documents for real estate for the first time, it is necessary to know what information is contained in one form or another. Since in a variety of papers it is not difficult to get confused.

Depending on the purpose for which you apply to the Cadastral Chamber, applications are written in several different forms:

  1. For registration.
  2. After making changes to object data.
  3. Deregistration of real estate.
  4. On entering information about previously registered land.

Any of the above statements reflects data on the owner of a land plot, apartment or residential building. A list of additionally provided documents is also entered and it is indicated how many copies of the passport will be provided. At your request, you can order several copies of the passport.

The application is filled out by hand. The form can be downloaded from the official website and filled out at home or obtained from an employee of the Cadastral Chamber and entered into the columns on the spot. You can download a sample form.

Sample passport

After you have provided all the necessary documents for consideration by the employees of the Cadastral Chamber, they will begin to prepare a passport for the property for you. It consists of two sheets.

The first page of the cadastral passport contains information related to the procedure for registering a property. For example, the number assigned during paperwork, the main technical characteristics of the property, the cadastral value and information about the owner are entered. The exact address, cadastral numbers of the address and the block in which the property is located are also indicated.

The title of the sheet indicates the full name of the document and for which object it was issued.

The floor plan is on the second page. In multi-storey buildings, the location of the apartment on the floor. If the object is a private individual building, then the plan reflects the location of the house on the site. However, in some cases this page may not be available. Below you see a new form on the example of samples of 2 sheets:

Both sheets of the cadastral passport are certified by the signature of an employee of the Cadastral Chamber. Also stamped on each sheet.

The above registration of the cadastral passport is relevant for documents that were received after 2013. Previously issued documents may differ in format and information contained in them. However, in general they are similar to each other. A request for a cadastral passport can be made.

the average is 5 working days. During this time, the submitted application, as well as the package of documents, will be fully checked by an employee of the Cadastral Chamber. All these documents, except for your passport, will be in the Cadastral Chamber, and in return you will be given a receipt for their acceptance.

The cadastral passport is valid for an unlimited period. However, if you are rebuilding your residential building or carrying out a major overhaul of an apartment, then you need to obtain a cadastral passport with new data. If you received a new technical passport, but the information in it has not changed, then the cadastral passport does not need to be changed.

In order to issue a cadastral passport for an apartment or get a copy of it, you need to understand how much it costs and how to pay the state fee. She is about 200 rubles. The amount may increase due to bank interest for transferring funds to a personal account, and a small fee is often taken at the cash desk of the chamber, which goes to pay the costs of issuing receipts and salaries to employees.

Payment Methods:

  1. To pay, you need to go to any branch of the bank and deposit money. In return (as confirmation of the operation) you will be given a receipt, which will need to be provided to the specialist of the Cadastral Chamber.
  2. There is another way to deposit funds: through the cash desk located in the very branch of the Cadastral Chamber.

During the pre-sale preparation, it is necessary to put all documents in order. Often you can find a situation where buyers ask the seller to update the cadastral passport. The fact is that banks in their requirements often indicate that this document must be received recently. This is one way to prevent real estate fraud.

It is necessary not only in cases where you make real estate transactions or after a major overhaul with a change in the layout of the rooms.

An updated passport is required to be submitted to the court to resolve cases of forced eviction, in addition to the passport, a number of other documents must be collected there.

Fresh documents from the BTI and the Cadastral Chamber will protect you from cases where the actual apartment or land plot does not match in size. Also, problems arise if a redevelopment has been made and is not reflected in the documentation, in this case it is also necessary to ask for a fresh cadastral passport. For those who buy an apartment without the participation of a bank, it is also recommended to request fresh documents from the relevant state authorities.

Registration of a cadastral passport is one of the most important tasks of the newly minted owner of an apartment in a new house. Without it, it is impossible to carry out such legal transactions with real estate as sale, bequest, obtaining permission for redevelopment.

The cadastral passport is one of the main documents for real estate. Information in the document is entered from the State Cadastral Register. In addition to a summary of the main characteristics of housing, there is a graphic part in the cadastral passport - an exact drawing of the apartment indicating square meters and the location of the main zones.

Grounds for obtaining a passport for an apartment:

  • obtaining a certificate of ownership of housing;
  • the need to legitimize the redevelopment carried out in the apartment;
  • purchase of an apartment in a new house, recently put into operation.

A cadastral passport is required if it is planned to carry out a major overhaul with redevelopment, resell housing in a new building, or enter one of the family members. This document will also be required at checkout.

The passport contains the following information:

  1. The date of registration of the object in the register and the cadastral number of the property.
  2. Type of dwelling - house, apartment.
  3. The floor number on which the apartment is located.
  4. The total number of storeys of the building.
  5. The date the building was put into operation.
  6. The main characteristics of the building.
  7. Features of sewer and heating systems.

After reviewing the cadastral passport, the architect can decide whether to give permission for the redevelopment of the apartment. The passport is also studied by banks that issue a mortgage loan for the purchase of housing in a new building by a client. This is due to the fact that at the time of the mortgage, the apartment will be pledged, which means that it must meet all building quality standards.

The data entered in the cadastral passport is necessary for the state registration of real estate, which indicates information about apartments, houses, land plots. The graphic representation of residential premises is indicated with maintaining a certain scale.

Required documents

To issue and receive a cadastral passport, you need to collect the following documents:

  • Russian passport of a citizen;
  • prepared statement;
  • documents confirming the right to real estate, this can be either a state-approved certificate or an exchange;
  • if the design is handled by an authorized person, a power of attorney certified by a notary is required;
  • receipt of payment of the fee for processing the document - state duty in the amount of 200 rubles.

All documents are provided in their original form, and an employee of the organization takes photocopies for consideration.

How to get a cadastral passport for an apartment in a new building

Before you start processing a cadastral passport, after buying an apartment in a new building, you need to contact the developer and clarify whether the house was transferred to any other company for trust management.

You can start collecting a package of documents and issuing a passport only after the act of transferring the residential complex to the management company is recorded.

There are three ways to get a cadastral passport:

  1. In a multifunctional center.
  2. In the registry office.
  3. On the Internet - on the website of Rosreestr.

Through the Land Registry:

  1. In the department of public administration, an application is filled out in the prescribed form for obtaining a cadastral passport. You should notify the registrar in advance that any changes have been made to the apartment, if any.
  2. A package of prepared documents is provided - originals and copies.
  3. All papers and information specified in the application are checked. After that, a receipt is issued on the acceptance of documents, the date of the specialist’s visit to the apartment and the date of issue of the finished document are set.
  4. You need to get a passport with a receipt issued by an employee. You should pay attention to the fact that the document contains an explication.

Type of cadastral passport:

Through the multifunctional center, a passport is issued in an identical way, only the acceptance of papers is carried out by an employee of the MFC, who issues a receipt indicating which documents were accepted for consideration. Verification takes place already in the cadastral chamber.

If you need to reduce the time for obtaining a passport, it is better to contact the State Cadastral Chamber directly, however, if it is too far away, and the receipt of a passport does not have to happen within the next few days, then you can contact the MFC.

The fastest way is to apply and issue a passport through the Rosreestr website:

  1. Go to the official website, select the "Cadastral passport" section. It should be noted that in 2019 the cadastral passport is issued together with an extract from the USRN containing information about all the characteristics of housing and residents registered in the apartment.
  2. To obtain an extract, you need to enter a cadastral number, however, when you first receive a passport after buying a new building, there is no such number yet, so you need to enter real estate data: the exact address, including the name of the region and locality.
  3. After entering the data, you need to pay the state duty on the receipt sent by e-mail;
  4. The finished passport in electronic form will be sent by e-mail within a few days.

Today, electronic documents are used as often as conventional ones. If the owner of the apartment wants to collect a pile of papers in the old fashioned way, he can download the sent passport and print it out.

The developer can transfer to the cadastral chamber only basic information about the apartment, while the registration of the technical card of the house, without which the cadastral passport will not be issued, the owner will have to deal with on their own.

I copy the finished technical plan in the BTI onto a disk that needs to be taken to the cadastral chamber. For a fee, they can transfer the necessary information over the Internet.

Obtaining a cadastral passport by an owner whose apartment has not yet been registered in the cadastral register is carried out according to the general algorithm, but with the addition of some actions.

So, without fail, an inspection of the housing will be carried out in order to make measurements and check the similarity with the plan available to the developer. The document will be issued only after the full processing of the data received during the inspection of the apartment.

Cost and terms of registration

If information about the apartment has not yet been entered into the cadastre, and the owner does not have a technical passport, then you will have to pay for its registration and BTI services, which will include drawing up a technical plan for the apartment.

Depending on the complexity, the services of a technical inventory bureau can cost from 3 to 10 thousand rubles.

You can get a passport at a low price - you only need to pay a state duty, for an electronic document - 150 rubles, for a paper one - 200 rubles.

Provided that information about the house has been entered in the register, the passport is issued within five days. This period can be extended up to 4 days if the documents were submitted to the MFC.

With the joint registration of technical and cadastral passports, more time will be required - up to 25 days. Since housing in new buildings is often not yet registered with the Rosreestre, such a period is assigned.

You can speed up the process by contacting specialists involved in the production of cadastral passports, however, in this case, the costs will only increase.

When they can refuse

Faced with a refusal to issue such an important document, apartment owners are indignant and perplexed, is the refusal justified?

According to the legislation, the issue of a cadastral passport can be refused if:

  • the necessary information about the apartment has not yet been entered into the cadastre, which is typical for new buildings;
  • the information provided by the owner of the apartment does not correspond to those indicated in Rosreestr;
  • not a complete package of documents was provided, or some of them are overdue;
  • the applicant does not have the right to receive information about real estate and issue a passport from the point of view of the law, since he is not the owner.

Depending on the reason for the refusal, you need to add missing documents or get new ones. If this does not help, the dispute can only be resolved in court.

To avoid problems with obtaining a cadastral passport, do not delay too much. You need to issue a document immediately after the purchase of real estate and entry into ownership. The most common reason for refusals to issue a passport is that persons who are not homeowners apply for it.

State duty

The amount of the state duty depends on which request related to the cadastral passport was asked.

For the issuance of a paper cadastral passport, a state duty is charged in the amount of:

The cadastral passport, plan and extract in electronic form are paid in the amount of 150 rubles.

Legal entities issuing a cadastral passport pay a fee of 600 rubles for issuing a paper version.
