Traffic rules transportation of people in a car. Is it allowed to transport people in the back of a truck? Other modes of transport

Today, trucking is practically the most common type of activity in the world. There are many road carriers that are ready to provide their services in the field of cargo transportation.

The regulation of the legal side of this activity is carried out by legislation and agreements that the parties enter into between themselves. The main set of legal norms that must be followed while traveling by vehicle in general, and when transporting goods in particular, is collection of Rules traffic . In it, relatively

The following requirements are specified:

1. The total mass of the transported cargo and the distribution of its weight on the axle vehicle must not exceed certain technical specification means of quantities.

2. The driver must check before starting the transportation, and the load is located, and also need to control it during the movement to prevent falling, dragging or injuring the persons who accompany the load, or creating any obstacles during the movement.

3. You can transport the goods according to the following conditions:
a) the load does not endanger the safety of road users;
b) the load does not impede driving and does not increase the stability of the vehicle;
c) the load does not restrict the driver's inspection;
d) visible external lighting fixtures, reflectors, recognition and license plates;
e) the cargo does not create any noise, and also does not raise dust or in any way pollute environment and the roadway.

4. Loads, vehicles in the front or rear parts by more than one meter and at the same time exceeding in width the distance of 40 cm from the edge of the marker lamp, must be marked in accordance with the requirements of paragraph 30.3 of the Rules of the Road.

5., as well as containers that have not been neutralized, are carried out in accordance with special rules, on which the movement of vehicles and, accordingly, their trains is allowed if at least one of the dimensions is exceeded in terms of width of 265 cm, in height - 400 cm (for container ships that are installed on routes - 435 cm). In length - 2200 cm (route vehicles - 2500 cm), the total mass of vehicles is over 38,000 kg, the load produced on a single axle is 10,000 kg, the load on axles that are doubled is 16,000 kg, the axles are triple - 22,000 kg (on routes determined by the Ministry of Transport and the State Traffic Inspectorate - 40,000 kg, for container ships - 44,000 kg, load on a single axle - 11,000 kg, load on dual axles - 18,000 kg, load on triple axles - 24,000 kg) or in the case if the load during movement protrudes beyond the rear of the vehicle for a distance exceeding 2 m. Axles are considered twin or, by definition, triple if the distance between them does not exceed 2.5 m.

AT passenger car cargo can be transported in the cabin, and in the trunk, and on the trunk. But subject to certain requirements.

1. Transportation of cargo is prohibited if it limits the driver's view.

If the load being transported obscures the rear view, this is only permissible if the vehicle is equipped with exterior rear-view mirrors on both sides.

However, if the cargo closes the view on the right or left, or, God forbid, in front, then the transportation of such cargo is strictly prohibited.

2. Transportation of cargo is prohibited if it makes it difficult to drive a vehicle.

To place the load, the driver pushed his seat forward a lot.

Now it will be difficult to drive a car. And, therefore, such transportation of goods is prohibited.

3. Transportation of cargo is prohibited if it violates the stability of the vehicle.

The vehicle is sensitive to a shift in the center of gravity. If the load is heavy, then with this arrangement the car will inevitably pull to the left.

And it’s better not to talk about turns or turns.

This is how to arrange the load - it's smart. And it does not contradict the requirements of the Rules.

4. Transportation of cargo is prohibited if it covers external lighting devices, as well as registration or identification marks.

I can't imagine the load that covers the headlights, and even more so, the front numbers. That is, you can imagine it - let's say the load on the trunk and hangs down to the ground. But in this case, the load necessarily closes the driver's view. And this alone is enough to make such transportation impossible.

But if the cargo closes rear numbers and block rear parking lights, then it does not interfere with movement.

But the Rules for such transportation of goods is prohibited.

5. Transportation of cargo is prohibited if it interferes with the perception of hand signals.

The rules refer to the situation when the direction indicators or brake lights fail on the way, and you need to somehow get to your destination. In this case, as you already know, the driver is required to give hand signals. So, if the cargo being transported prevents other drivers from seeing these signals, further movement is prohibited.

6. Transportation of cargo is prohibited if it is noisy, dusty and pollutes the environment.

One can imagine how a cargo can dust or pollute the environment. But how he can make noise, by God, I don’t know.

7. If the cargo protrudes beyond the dimensions of the vehicle.

less than 1 meter ,

If the load protrudes beyond the dimensions of the vehicle in front or behind more than 1 meter , then…

... during daylight hours, the cargo both in front and behind must be marked with identification marks " Oversized cargo»…

... and at night or in conditions of insufficient visibility, in addition to the sign in front, the cargo must be marked with a lantern or retroreflector white color, and behind - a flashlight or a red reflector.

If the performance behind more than 2 meters, the transportation of such cargo must be agreed with the traffic police department, on the territory of which the transportation route begins. That is, for you and me, this simply means that the transportation of such cargo is prohibited.

Interestingly, the Rules did not limit the protrusion of the cargo in front. And, therefore, here the driver needs to be guided by common sense.

8. If the cargo protrudes from the side of the vehicle.

As for the protrusion of the load from the side, here the Rules set a difficult task for the drivers. It is necessary to measure the distance from extreme point the size of the car, and from the edge side light.

If the protrusion of the load from the edge of the marker light does not exceed 0.4 meters, and the total width of the load no more than 2.55 meters, nothing to worry about. You can safely carry such a load.

If the protrusion of the cargo from the edge of the side light exceeds 0.4 meters, but the width of the cargo is not more than 2.55 meters, such cargo is allowed to be transported. It just needs to be marked.

During daylight hours, such cargo must be marked on both sides with identification signs "Oversized cargo".

At night and in conditions of insufficient visibility, the cargo, in addition to signs, must be marked in front with white lamps or retroreflectors, and in the rear with red lamps or retroreflectors.

If the width of the load exceeds 2.55 meters (regardless of how much it protrudes from the side), consider that the carriage of such a load is prohibited.

The rules for the carriage of passengers in the SDA are given special attention, since the car has always been considered a source of increased danger. Changes are made to this section from time to time, especially if the death rate of passengers in road accidents increases for one reason or another. The requirements for the carriage of passengers are specified in paragraph 22 of the Rules.

Disembarkation and embarkation of passengers

The driver of the vehicle should disembark and alight passengers only after the vehicle has come to a complete stop. Driving is only permitted with the doors fully closed.

This rule is mandatory, but not all drivers comply with it, starting off even when the passenger door of the vehicle is open.

In this situation, there is a violation of more than one rule, since the driver of the vehicle and passengers are required to buckle up before the start of movement.

Transportation of passengers in a car

Paragraph 22.8 of the SDA establishes the following restrictions:

  • in any type of vehicle, except for the carriage of passengers in a van body or the body of a cargo transport vehicle with an onboard platform, it is prohibited to carry passengers outside the cabin or additional structures for motorcycles;
  • it is unacceptable to transport people in an amount exceeding the allowable characteristics of the norm.

At the first point, some drivers periodically close their eyes, carrying people not only in the cab of the car, but also on the hoods, in the trunk, on the roof of the vehicle. At the same time, it should be borne in mind that the blame for the death of passengers in the event of their death will fall only on the driver who did not take care of ensuring their safety.

The fine for violation of the rules for the carriage of passengers is 1000 rubles.

For the execution of the second paragraph, a limited number of seats is provided for in the case of passenger cars or a limitation on technical characteristics for a large public transport such as buses, trolleybuses or trams.

For the transportation of an additional person in a car, a fine of 500 rubles is provided in accordance with Article 12.23 of the Code of Administrative Offenses. Also, the inspector has the right to issue an additional fine for carrying a passenger without using a seat belt.

Violation of the rule for the carriage of passengers can be observed in a situation where there are 6 people in the car instead of 5, and there is no seat belt for the sixth person, which means he will not be able to use protection.

Rules for ensuring the safety of passenger transportation

From January 2012, seat belts are mandatory for all types of vehicles.

In accordance with clause 2.1.2 of the SDA, drivers are required to carry their passengers using safety belts, and if there is an unfastened passenger, do not start moving.

In the case when children under the age of 12 are transported, the driver needs to install a special restraint in the cabin that can securely fix the small passenger. A child may only be transported in the front seat using child seat. At the same time, it is forbidden to transport a child in the back seat of a motorcycle.

Rules for the transportation of people in the back of a truck

in the body truck Passengers can only be transported by a driver who has a driving license of category C or subcategory C1 for 3 years or more.

If more than 8, but not more than 16 people are transported in the back of a truck, taking into account the driver and passengers in the cab, then the driver must have category B or subcategory D1. In the case of transportation of more than 16 people, taking into account the driver and passengers inside the cabin, only category D is required.

As for the flatbed truck, then with special equipment it is allowed to transport adults. Transportation of children is prohibited. If the onboard platform is not equipped for the carriage of passengers, then travel in such a body is permissible only for persons accompanying the cargo or traveling to receive the latter. But then you need an equipped seat lower than the level of the sides.

Should not be carried in the back of a truck more people than allowed by the specifications or more than available seats.

Before starting the movement, the truck driver is obliged to instruct passengers on the rules for boarding, disembarking, positioning and behavior in the body.

Rules for the carriage of passengers in buses

Organized transportation of children is allowed only in special buses, which have identification marks "Transportation of children".

The driver should remember that he himself must ensure the life and health of his passengers, since this responsibility lies with him.

Video: Rules for the carriage of passengers by car

Alexander, hello.

1. Intercity routes are routes between settlements, if there are more than 50 km between the borders of these settlements. :

4. Intercity transportation is carried out between settlements at a distance of more than fifty kilometers between the borders of these settlements.

2. It is not allowed to carry passengers standing on intercity routes.

3. In commuter traffic, traffic rules do not prohibit the carriage of passengers while standing.

Good luck on the roads!

Good afternoon, tell me under what conditions can I transport a child of 5 years old on a moped and can I do it at all? Thank you.

Basil, hello.

Clause 24.8 of the SDA:

24.8. Cyclists and moped drivers are prohibited from:

transport children under 7 years of age in the absence of specially equipped places for them;

To transport a child, you need a specially equipped place for this. This concept in the rules is not deciphered.

Obviously, if a moped has a seat designed only for the driver, then no one can be transported on it. If a special child seat for a moped is installed, then you can transport a child. As for the intermediate options, I can’t predict what they will be referred to by the traffic police.

Good luck on the roads!

Sergey-177

Good afternoon!

Good afternoon!

The following situation is of interest: transportation of three children under 5 years old by car without special restraints. Is there a fine for each child without special restraints, or one fine for the mere fact of transporting children without restraints?

The driver once, well, each child is also fined.

Hello. Are seat belts required in the cabin on a 22-seat Ford Transit bus when transporting a watch (non-commercial) in the city?

If it is equipped with them, then they are needed. If not provided by the manufacturer, then no.

I wonder if it is possible to transport a child in a car seat in the cab truck?

22.9. Transportation of children is allowed provided that their safety is ensured, taking into account the design features of the vehicle.

Transportation of children under 12 years of age in vehicles equipped with seat belts must be carried out using child restraints appropriate for the weight and height of the child, or other means that allow the child to be fastened using the seat belts provided for by the design of the vehicle, and in the front seat car - only with the use of child restraints.

As you can see, for a truck there are no restrictions for the front seat. If the truck is equipped with seat belts, then transportation must be carried out using child restraints ... and of course, a car seat is not prohibited, but only encouraged.

Alexey-133

Good afternoon.

The car has 5 seats. We are three adults with a driver and three children. Three children and one adult will be placed in the back seat. Children are 4, 5 and 7 years old. All wearing seat belts, one seat belt for two children. Instead of chairs, there will be ordinary high pillows so that the seat belt does not press on the child's neck ...

I rummaged through the Internet, the answers are contradictory, on the one hand, it is forbidden to transport passengers in excess of the number provided for by the technical characteristics of the vehicle. Thus, you violate traffic rules, for which liability is provided for under Art. 12.23 ....... on the other 22.7. It is forbidden to carry passengers: in excess of the number provided for by the technical characteristics of the vehicle, excluding children under 12 years of age. At the same time, the actual weight of the vehicle must not exceed the permitted maximum weight established by the manufacturer, and the number of children under 12 years of age must not exceed the number of seats for passengers; We don't have one child under the age of 12.

Alexei, hello.

Clause 22.8 of the SDA:

22.8. It is forbidden to transport people:

outside the cab of a car (except for cases of transportation of people in the body of a truck with an onboard platform or in a van body), a tractor, other self-propelled vehicles, on a cargo trailer, in a cottage trailer, in the body of a cargo motorcycle and outside the seats provided for by the design of the motorcycle;

in excess of the amount provided for by the technical characteristics of the vehicle.

If you need to transport 6 people, then look towards 7-seater cars. There are many such offers on the market. Both new and used.

It is forbidden to carry passengers: in excess of the number provided for by the technical characteristics of the vehicle, excluding children under 12 years of age.

Alexey-133

Tatiana-109

Hello! Is it possible to transport a child (4 years old) on a single motorcycle (without a sidecar) in the middle (between parents) in a helmet?

Tatiana, hello.

Clause 22.9 of the SDA:

It is forbidden to transport children under 12 years of age in the back seat of a motorcycle.

How many seats does your motorcycle have according to the documents?

Dmitry-285

Good afternoon, please tell me, my car does not have seat belts for rear passengers. I have two children aged 2 and 10. The youngest sits in the front seat in a chair. How can I transport the older one?

Tatiana-109

Maxim, hello! If you can’t go back, then you can put it forward? Do you need to fasten it to the parent somehow? Specifically, in our case, how should, or how can we act according to traffic rules? The situation is this: a motorcycle (let 3 places), me, husband, child. We want to go. How to do it right? And about our motorcycle, we have 2 seats, as I understand it, we cannot ride together with a child?)

IMHO, Oka can be taken cheaper than most motorcycles. It can be ridden by three or four people! And so the child can be put on the tank, you can tie the leg to the rear shock absorber ... And so and so - illegally! You can put it in a backpack. And if you really want it on a motorcycle and according to the law, then attach the stroller to the motorcycle, and you can LEGALLY transport children in the stroller!

Dmitry, hello.

Transportation of children under 12 years of age in vehicles, equipped with seat belts, must be carried out using child restraints corresponding to the weight and height of the child, or other means that allow you to fasten the child using the seat belts provided for by the design of the vehicle, and in the front seat of a car - only using child restraints.

Transporting a child in the back seat of a car without seat belts is possible without the use of a restraint.

Lack of seat belts is unsafe in any case. I recommend that you consider solving this problem. Children need to be protected.

Good luck on the roads!

Is it allowed by the rules to transport a disabled person of group 2 in a lying position, for example, in a jeep, if you expand part of the rear seat, arrange the bed partly on the seat, partly in the trunk (a person of small stature) and provided that he is fastened with a seat belt (the trunk is equipped with such belt). And if not, what is the fine.

It is forbidden to transport disabled persons of any group unfastened. Or carry them in the car of the Ministry of Emergency Situations or in the Ambulance. Fine 1500 rubles.

Good evening! We want to go south, 4 adults and two children, 1 child is 6 years old, the second is 11 months old) the eldest has a car seat, everything is as it should be, and the second daughter turns out to be 6 people in the car, can she be transported in her arms ??

It probably depends on a lot, incl. and from family income and from the health of parents ... It’s easier for someone to give birth to a new one, in which case, someone buy some thread of a seven-seater Largus and drive as expected. You can carry your youngest daughter not only in your arms. You can put it in the trunk in a box. You can put it in a trailer ... You can put the roof rack on the arcs, but there you either have to stop periodically and ventilate, or invent a ventilation system, because the trunk is almost airtight there. Again, in the trailer and in the upper trunk, the child, if anything, will not be heard. There will be no distraction from management ... So there is no unequivocal advice ...

Oksana, hello.

From the point of view of traffic rules:

in excess of the amount provided for by the technical characteristics of the vehicle.

6 people can only travel in a car with 6 or more seats. In this case, there should be no problems with placing a second child seat.

Good luck on the roads!

We transfer perishables by truck, working 2 drivers in the cab. Question: can the co-driver sleep on the move if the sleeping bag is equipped with a passenger restraint device (safety bracket)?

There is no ban on the transportation of a lying passenger in the traffic rules, so if the design provides for such an option, then there should be no problems.

Good luck on the roads!

In Russia, finally, which relate to the rules for transporting children in cars. So from now on, the new rules for the transportation of children under the age of 11 are regulated by changes in the rules of the road, adopted by Decree of the Government of the Russian Federation No. 761 of June 28, 2017.

So, for example, new rules oblige drivers to transport children under the age of 7 years only using child restraint systems (), corresponding to the weight and height of the child. That is, from now on, it is strictly forbidden to transport children using "belt adapters", frameless devices and other seat belt guides. For violation of this rule of traffic rules, the driver faces a fine of 3,000 rubles.

Children under the age of 7 are only allowed in car seats and boosters.

How can children under the age of 7 be transported in a car?

Recall that earlier legislation allowed drivers, when transporting children, to use, in addition to car seats and boosters, various "other devices" , which include: book, frameless device, corrector (adapter) seat belt straps.

But, according to the change in the traffic rules, now the words "other devices" removed on the basis of Government Decree No. 761 dated 06/28/2017.

Accordingly, the transportation of children under the age of 7 is now possible only in special car seats, boosters, which take into account the height and weight of the child.

So, according to the new Decree of the Government of the Russian Federation No. 761, changes are made to clause 22.9 in the rules of the road:

SDA 29.9 Transportation of children in a car

"Carriage of children under the age of 7 years in a passenger car and truck cab, which are designed with seat belts or seat belts and an ISOFIX* child restraint system, must be carried out using child restraint systems (devices) that are appropriate for the weight and height of the child.

* The name of the ISOFIX child restraint system is given in accordance with technical regulation Customs Union TR RS 018/2011 "On the safety of wheeled vehicles".

The ban on nurseries for transporting children was necessary in connection with studies that found that such devices not only do not protect children during an accident, but also exacerbate the consequences of an accident.

So, as a result of comprehensive tests, experts found that such devices do not provide adequate safety for children compared to car seats and boosters.

It is also worth noting that during the testing of frameless child restraints automotive devices, seat belt adapters and other similar devices, it turned out that the consequences of an accident for the child are aggravated compared to the seat belts provided for by the design of the vehicle and used to fix the child without any additional devices.

That is, in other words, seat belt adapters, frameless devices, etc., cause more harm than simple car seat belts.

How to transport children aged 7 to 11?

According to the change in the traffic rules of the Russian Federation, on the basis of Decree of the Government of the Russian Federation No. 761, in clause 29.9, changes have also been made related to the transportation of children aged 7 to 11 years.

Here is a quote from the new traffic rules:

Children between the ages of 7 and 11 (inclusive) in a passenger car and truck cab designed with seat belts or seat belts and an ISOFIX child restraint system must use (devices) appropriate for the weight and height of the child, or using seat belts, and in the front seat of a car - only with the use of child restraint systems (devices) corresponding to the weight and height of the child.

The installation of child restraint systems (devices) in a passenger car and the cab of a truck and the placement of children in them must be carried out in accordance with the operating manual for these systems (devices).

It is forbidden to transport children under the age of 12 in the back seat of a motorcycle.

Can a child between the ages of 7 and 11 be transported in the front seat without using a car seat?

According to a new change in the SDA (in paragraph 29.9), children aged 7 to 11 years are prohibited from transporting without a car seat in the front seat.

Accordingly, in case of violation of this paragraph of the SDA, the driver faces a fine for violating the rules for transporting children in a car. A fine of 3,000 rubles.

Can children between the ages of 7 and 11 be transported in the back seat of a car without a car seat?

Yes, according to the Government Decree, which amends clause 29.9 of the SDA of the Russian Federation, it is allowed to transport a child in the back seat between the ages of 7 and 11, both in a car seat and without it. But in this case mandatory use of seat belts.

Accordingly, the use of seat belt adapters and frameless child restraints to transport children in a vehicle is prohibited.

So, under the new legislation, the driver has the right to carry a child in the back seat without using a car seat. In this case, you need to fasten a child aged 7 to 11 years old with a standard vehicle seat belt.

Is it dangerous to transport children between the ages of 7 and 11 without car seats?

It is worth noting that the appearance in the rules of the road of a clause allowing the transportation of children from 7 to 11 years old, on the one hand, simplifies the rules for transporting a child in a car, but on the other hand, it makes one think, since the transportation of children using seat belts does not always provide adequate protection during an accident .

It's all about the height and weight of a child aged 7 to 11 years. Let's face it, kids are different. For example, it is not uncommon for a child of 7-8 years of age to have the same height and weight as a child of 10-11 years of age, and vice versa, it is not uncommon for a child of 11 years of age to have a small weight and height comparable to a younger child.

Accordingly, if you fasten a seat belt on a child aged 10-11 years old who looks like a child of 7-9 years old (due to height and weight), then the seat belt will not be able to fully protect the child from the serious consequences of an accident, since the seat belt in principle intended for passengers of height and weight, which, as a rule, corresponds to people over 12 years old.

So we recommend that drivers still use a strictly special car seat for transporting children under the age of 11, which is naturally safer for your child compared to conventional seat belts.

Yes, of course, if your child of 10-11 years old looks like a teenager of 12-14 years old, then it is not advisable to buy a special chair for him. In this case, it is worth using regular seat belts when transporting a child in the back seat.

Remember that just because the law allows children between the ages of 7 and 11 to be transported without a seat, this does not mean that it is most suitable for your child. safe way transportation. The main thing is height and weight.

For example, if your child is not tall enough, then if he is wearing a seat belt in the back seat, there is a risk that during an accident the lap belt will move to the stomach, which can lead to severe abdominal injury, which is naturally life-threatening for the child.

This is due to the peculiarities of the skeletal structure of children under the age of 12 years. Accordingly, if your child is small in stature and light in weight, and despite the fact that his age allows you, in accordance with applicable law, to transport children using seat belts, it is best to use all the same to ensure that the child maximum protection in case of an accident.

Also remember that in no case should you transport children aged 7 to 11 in the front seat using a seat belt, since this not only now prohibits paragraph 29.9 of the traffic rules, for violation of which you face a fine of 3,000 rubles, but and very dangerous, because even with a minor accident, a child in the front seat can be severely injured.

When will the new rules for transporting children in a car come into force?

According to the current legislation, the Decree of the Government comes into force after seven days from the date of their official publication. Since Decree No. 761 of June 28, 2017 was officially published on the website of the Government of the Russian Federation on July 03, 2017, the new rules for transporting children in a car will come into force on July 10, 2017.
